Terms of Service
Review the terms that govern GalleryPlanner, including acceptable use, subscriptions, billing, refunds, warranties, service limits, and important liability details.

These Terms of Service ("Terms") govern your use of GalleryPlanner (the "Service"), operated by Timothy Straub ("we", "us", or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
GalleryPlanner is a web-based gallery wall planning tool.
Current core behavior is local-first:
- Your projects, layouts, and photos are stored locally in your browser.
- We do not upload your project photos or layouts to our servers.
- If you clear browser storage or lose local project files, we cannot recover them for you.
We may add, modify, suspend, or remove features at any time.
2. Eligibility and Children
The Service is for general audiences and is not directed to children under 13. We do not knowingly collect personal information from children under 13.
If you are under 13, use the Service only with a parent or legal guardian and do not submit personal information (for example, through support or newsletter forms).
3. Acceptable Use
You agree not to:
- Use the Service for unlawful activity.
- Attempt unauthorized access to the Service or related systems.
- Introduce malware or other harmful code.
- Interfere with the operation or security of the Service.
- Reverse engineer, copy, scrape, or resell the Service, except as allowed by law.
4. Paid Features, Billing, and Processor
Some features may require payment (for example, GalleryPlanner Pro lifetime access or Pro Pass access).
- Prices and product availability may change at any time.
- Any change will not alter rights already granted for completed purchases.
- Payments are processed by Lemon Squeezy, and purchases are also subject to Lemon Squeezy terms and policies.
- Pro Pass access is time-limited and expires automatically at the end of the purchased term shown at checkout (for example, 3-day, 7-day, or 30-day pass options).
- Unless otherwise stated at checkout, a Pro Pass begins when first activated in-product (for example, on the first strict Pro-gated action after purchase).
- There is currently no auto-renewing subscription product.
"Lifetime" access means access for as long as the GalleryPlanner product and relevant Pro features are offered. It does not guarantee perpetual operation of the Service.
5. Refunds
Refund eligibility and process are described in the Refund Policy.
6. Intellectual Property
The Service, including its software, design, content, and branding, is owned by Timothy Straub and protected by applicable intellectual property laws. Except as permitted by law, you may not copy, modify, distribute, or create derivative works from the Service without written permission.
The Service also includes third-party open source components and assets. Those components remain subject to their respective licenses, which are listed in our Open Source Notices & Credits.
The heic-to library (1.4.2, LGPL-3.0) is licensed separately. Nothing in these Terms limits rights granted by LGPL-3.0 Section 4, including rights to access, modify, debug, and replace that library component. License texts and source archive are available at /licenses/heic-to/.
7. Privacy
Your use of the Service is also governed by our Privacy Policy.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or fully secure.
9. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.
- Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless Timothy Straub and related parties from claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of applicable law.
11. Suspension and Termination
We may suspend or terminate access to the Service if you violate these Terms or if needed to protect the Service, users, or legal compliance.
Upon termination, your right to use the Service ends immediately.
12. Changes to These Terms
We may update these Terms from time to time. If material changes are made, we may notify you by posting an updated version in the Service or by email if you have contacted us previously. Continued use after changes take effect means you accept the updated Terms.
Changes to pricing, products, or refund eligibility apply prospectively and will not retroactively affect completed purchases.
13. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law rules.
Any dispute arising from these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association, except:
- Either party may bring an individual claim in small claims court if it qualifies.
- Either party may seek injunctive relief in court for intellectual property misuse.
Disputes must be brought on an individual basis only, and not as part of a class or representative action.
